These Terms & Conditions (“Terms”) govern your use of our website, mobile applications, online courses, and related services (collectively, the “Platform”). By creating an account, purchasing a course, or using any of our services, you agree to these Terms. Please read them carefully.

1. Acceptance of Terms

1.1. By accessing or using our Platform, you confirm that you have read, understood, and agree to be bound by these Terms.
1.2. If you do not agree, you must discontinue use of our services immediately.
1.3. These Terms apply to all users, including learners, parents/guardians (for minors), and corporate clients.

2. Eligibility

2.1. You must be at least 16 years old to use our services.
2.2. If under 18, you may only access the Platform under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.
2.3. By registering, you represent that you have the legal capacity to enter into a binding agreement under the laws of Kenya.

3. User Accounts

3.1. To access courses, you must create a personal account.
3.2. You are responsible for safeguarding your login credentials and all activity under your account.
3.3. You agree not to share, sell, or transfer your account to others.
3.4. AfriLearn Solutions Limited will not be liable for any loss resulting from unauthorized account use.

4. Use of Services

4.1. You may use the Platform for lawful educational purposes only.
4.2. You agree not to:

  • Copy, distribute, or resell course materials without written consent.

     

  • Upload harmful, offensive, or illegal content.

     

  • Misuse interactive tools for cheating, plagiarism, or fraudulent activity.

     

  • Interfere with the security or operation of our Platform.

     

4.3. Any violation of these Terms may result in suspension or termination of your account without refund.

5. Course Access & Delivery

5.1. Upon payment, you are granted a limited, non-transferable license to access the purchased course(s) for the duration specified.
5.2. Course materials, including videos, quizzes, and downloadable files, are intended solely for your personal use.
5.3. We reserve the right to modify, update, or discontinue any course or feature at our discretion.

6. Payments & Pricing

6.1. All fees must be paid in full prior to course access, unless otherwise agreed for corporate clients.
6.2. Prices are displayed in Kenyan Shillings (KES) or other applicable currencies.
6.3. AfriLearn is not responsible for transaction fees, bank charges, or currency exchange fluctuations.
6.4. Discounts, promotions, or scholarships may be offered but are not guaranteed.

7. Refund Policy

7.1. Refunds are available only under the following conditions:

  • Request is made within 7 days of purchase.

     

  • You have accessed less than 20% of the course content.

     

7.2. Refunds will not be provided if:

  • You have substantially completed or downloaded the course materials.

     

  • You fail to meet technical requirements (e.g., internet access, device compatibility).

     

  • Corporate training sessions have already commenced.

     

7.3. Refund requests must be submitted in writing to [email protected]. Approved refunds will be processed within 10–15 working days.

8. Intellectual Property Rights

8.1. All Platform content, including but not limited to text, graphics, software, logos, videos, and training materials, is the intellectual property of AfriLearn Solutions Limited.
8.2. You may not copy, reproduce, modify, or distribute our materials without prior written authorization.
8.3. Certificates issued remain the property of AfriLearn Solutions Limited and may be revoked if obtained fraudulently.

9. Third-Party Services

9.1. Our Platform may integrate or link to third-party tools, websites, or resources.
9.2. AfriLearn does not control or endorse third-party content and is not liable for its accuracy, availability, or reliability.
9.3. Your use of third-party resources is subject to their own terms and policies.

10. Privacy Policy

10.1. We respect your privacy. Personal data collected (e.g., name, email, phone, payment details) is used solely for course delivery, certification, and communication.
10.2. We implement appropriate security measures to protect user information.
10.3. We do not sell or rent personal data to unauthorized third parties.

11. Limitation of Liability

11.1. AfriLearn Solutions Limited provides educational services “as is” and “as available.”
11.2. We make no guarantees that completion of a course will lead to academic success, employment, or financial gain.
11.3. We are not responsible for technical failures beyond our control (e.g., internet outages, device incompatibility).
11.4. To the fullest extent permitted by law, our total liability shall not exceed the amount paid for the specific course.

12. Disclaimer of Warranties

12.1. While we strive for accuracy, we do not warrant that all content will be error-free, uninterrupted, or suitable for every learner.
12.2. Learning outcomes depend on individual effort, participation, and application of knowledge.

13. Code of Conduct

13.1. Learners must:

  • Participate respectfully in discussions, forums, and live sessions.

     

  • Avoid harassment, hate speech, or disruptive behavior.

     

  • Uphold academic integrity by avoiding plagiarism or cheating.

     

13.2. Breaches of conduct may result in suspension, termination, or revocation of certificates.

14. Termination of Services

14.1. We may suspend or terminate your account if you:

  • Breach these Terms.

     

  • Engage in fraudulent or abusive behavior.

     

  • Fail to pay applicable fees.

     

14.2. Upon termination, you lose access to all purchased courses without entitlement to a refund.

15. Governing Law & Dispute Resolution

15.1. These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya.
15.2. In case of disputes, both parties agree to attempt amicable settlement through negotiation.
15.3. If unresolved, disputes shall be referred to arbitration in Nairobi, Kenya, under the provisions of the Kenyan Arbitration Act.
15.4. The arbitral award shall be final and binding.

16. Modifications to Terms

16.1. AfriLearn Solutions Limited reserves the right to amend or update these Terms at any time.
16.2. Updated Terms will be posted on our website with the “Last Updated” date.
16.3. Continued use of the Platform after modifications constitutes acceptance of the revised Terms.
